Just too many vulnerables out there!

I have just received a call for Probono advice. The guy said he approached a money lender or a loan-negotiator on 13-6 to ask for a temporary loan of 120k. He was asked to sign a memorandum to pay for the handling fee of 20k in case of declining the loan upon their successful arrangement. Over the weekend, the guy reconsidered the loan application and decided to cancel it on 16-6. But he was told to pay up the handling fee. Subject to the review of his paper, my initial advice was that it was probably an unconscionable contract, a case of misrepresentation and lack of consideration too. The penalty was also excessive and therefore the contract, if any, could be repudiated. In short, he should write to state his case on a without prejudice basis and asked for a settlement of the dispute by offering 2k to them instead. He acknowledged and said he would follow.
Really, there are so many crooks out there to prey on the victims who are not difficult to be targeted.

有人剛來電求助，說上週五到財務公司申請短期的120,000債務，手續費為20,000，經週末冷靜思考後，於今週一通知財務公司取消借貸，但被苛索20000，問如如何是好？我初歩建議他，那合約可能有不公允和誤導成份、財務公司未有付出合理代價，罰款額太高和不合理，那合約可被撤銷，先試試息事寧人做法，去信否認任何責任，但願意付2000以便和解了事！
