2012年3月21日星期三這個晚上，馬道立首席法官被邀請來參加這個關於司法機構與全球化的會議。我覺得這個主題正好是現今香港社會所面對的現實問題。在香港，基本法規定了一個三權分立的體制保障權益。然而另一方面，司法機構又是政府的一部分，在法定範圍內審議政府工作。在法律程序上，過多的酌情權並沒有太多的好處（？），法院系統，陪審團制度；舉證責任，辯護的公平；第三方面是所有法官任命應該建立在司法獨立的基礎上。
公眾利益的保護，需要保持司法獨立，公平公正不受干擾地去履行這個義務。

On this evening, Wednesday 21st March, 2012, the Honorable CJ MA was invited to address the congregation on the topic of Independence of Judiciary and Globalization. It is true that we have this as the bedrock of the HK society. In HK, there is a separation of powers guaranteed by various articles in our BL. However, judiciary is part of the government in scrutinizing the work of the government in the context of legality. In terms of the procedural aspects, too much of discretion is no good (?) however, the court system , trial by jury; burden of proof and equality of arms in representation; the third aspect is the appointment of judges all form the integral parts of the independence of judiciary.
Public interest has it that we need to retain judicial independence, to discharge the duty without fear and favour.
Judicial independence is a living concept which continues to evolve.

Professor Shetreet spoke that it is important to have judicial independence in the context of globalization otherwise it is difficult to resolve the disputes consistently in different jurisdictions. Without which, investors would not re invest again!
