5月5日那天,我面見了大約70位心急如焚的買家,他們購買了房地產開發商發售的日出康城未完工樓盤,近日他們被告知該工程將會比原定的完工日期推遲90天左右。很多人問到是否由於惡劣的天氣和聲稱的火災事故而導致了這次的延期,是否有是次延期的證明文件。在目前這樣的情況下,買方擁有什麼權利和可以得到什麼保護,他們應該如何處對?經商討後,參會者一致同意,除了按照合同的規定行使自己的合法權益外,還可以採取其他的一些法律措施給開發商施加壓力,例如致力縮減延期時間,質疑AP的延期證明,並要求詳細交代延期的理由等等;或尋求消費者委員會的協助;藉著AP證書內容寫信給各政府部門尋求幫助和驗證。這次討論會是由沙田區議會區議員Christina Fong統籌,日出康城的買家們請她幫忙,Christina隨即找我一起處理。
Le Prime/Le Prestige
On 5th May, I met a group of about 70 anxious purchasers who brought uncompleted units from the developer of Le Prime. They had just been informed by the developer that there would be a delay of 90 days for completion from the original completion date. Questions were raised on the appropriateness of such Authorised Person’s certificate for extension of time due to the purported inclement weather and fire accident. What rights and protection would be provided to the purchasers in these circumstances? How should they deal with their own situation….? It was agreed that apart from taking their contractual rights as they were entitled to in law, certain pre-legal actions had to be taken in order to put pressure on the developer to reduce the delay, such as writing to challenge the purported Authorised Person’s certificate and asking for detailed justification; contacting Consumer Council for help; writing to various government departments for help and verification of the basis of the Authorised Person’s certificate. The discussion was arranged by the Shatin District Councillor, Ms. Christine Fong, who was approached by the purchasers for assistance. And I was then approached in turn.
