Is a proxy valid if it is signed before issuing a written notice for general meetings?
The above question is addressed in LDBM 247/2009 and involves several arguing points
In this case, the answer is “yes” as long as the proxy contains the necessary details i.e. the date and the time of the general meeting in which the deponent requests the authorised person to attend (refer to Paragraph 21).
In this situation it is worth paying attention to the following indentified areas:-
- Building Management matters in providing services which involve financial gains are often problematic since there will no doubt be conflicts when benefits are involved and it is often the root of disputes;
- Where financial gains are involved Company Management and businesses who participate in bidding for construction have a somewhat subtle relationship;
- When solving these disputes through the Lands Tribunal it is often time-consuming and the result is not too ideal;
- Certain air borne representatives appointed by the landlords at last minute who participate in conferences will often tend to complicate the meeting;
- Whether the Home Affairs Department can play a more significant role in resolving doubts and disputes amongst residents and owners;
- The number of staff in the Lands Tribunal should be increased to improve efficiency and to shorten the time in handling cases; and
- Whether the government should re-establish the Building Management Resources Centre and subscribe legal services for the residents.
