當John被主席邀請就這議題發言及分享他在英國的經驗時,他認為使用DHL替律師樓送遞包裹並沒有太大差別。
我也向大家分享了香港的情況,目前除了個人資料(私隱)條例及律師專業守則外,沒有其他複雜的法例去保障客戶的私隱。雖然律師違反了保密守則不須面對刑事責任,但他們可能須接受律師會的紀律處分。
John Wotton’s view
Upon being requested by the chair to speak and share the United Kingdom’s experience on this issue, John said that he did not see too much of a difference from using DHL to carry and deliver parcels for law firms. I explained about the situation in Hong Kong that we have not yet got any complicated law to govern this situation except that we already have the Personal Data (Privacy) Ordinance and solicitors’ professional guide with code of ethics protecting clients’ confidentiality. Although wrongful breaches of such by lawyers do not currently warrant criminal prosecution, they are however subjected to professional disciplinary action.
