Wolfgang Ewer教授談到在現代資訊科技數據傳輸和儲存下,專業保密的做法。他強調在德國,服務供應商有合同,數據保護法和數據處理法定限制。
會長Axel C. Filges說,律師違反保密條例就要被檢控,嚴重的一經定罪要被罰款30,000歐元。歐盟將會進一步制定加強法律,律師有義務做得比以往更加嚴格。
這如何與事務所的非雇員外判工作的概念配合?Klaus-Stefan Honenstatt博士說,律師必須小心取得非法律意義上的外判和保密條例之間的平衡,他們必須持續地審查保密方面的問題。
Jonathan Goldsmith先生談到在自己的服務器以外儲存資料時的雲端運作及其內在問題。它跟傳統地在倉庫存儲文件有何分別?如何考慮其實用性?應否使用電子郵件?應否使用iPhone?…等等。
他指出一些大律師協會,如西班牙大律師協會,鼓勵他們的會員使用雲端解決方案,而應該安裝某些代碼和規則以考量服務供應商的盡職審查,資料存儲的位置和客戶的批準。或會有歐盟愛國者法案阻止他們的資料存儲在它們國內,如何解決?資料是又如何分開?
所有這些都必須周詳考慮!

Professor Wolfgang Ewer spoke about the preservation of professional confidentiality in light of modern information technology for data transmission and storage. He emphasized that in Germany service providers are imposed with contractual and statutory obligations under data protection and data processing laws which are governed under the Federal Data Protection Act.
President Axel C. Filges stated that lawyers would be prosecuted for breaches of confidentiality and if convicted of a serious offense, penalised with fines of up to 30,000 euro. The European Union will enact further to tighten this area of law in which lawyers will be under a stringent obligation to adhere to.
How is this to be tallied with the concept of outsourcing work to non -employees of other firms? Dr. Klaus-Stefan Hohenstatt said that lawyers will need to be more careful whilst attempting to strike a balance between non legal outsourcing of knowledge bases. They must question the issue of confidentiality on a continuous basis and examine it from time to time.
Mr. Jonathan Goldsmith spoke about cloud computing and the inherent problems therewith on data being stored outside of ones own server. How different was this when compared to the traditional storage of documents at a godown?
What practicalities should be considered? Should emails be used? Should iPhones be used? Etc.
He noted that some Bars such as the Spanish Bar encourages members to use cloud solution and that certain codes and regulations should be installed to consider the aspects of due diligence on service providers, location of data storage and consents from clients. There may also be patriot acts in the European Union which prohibit European Union subjects from storing their data in the States, how would this be solved? How would the data be divided?
All these aspects need to be carefully thought through!
